Terms and Conditions for ddata App

1. Introduction
Welcome to the ddata privilege mobile application ("App"), operated by SWAYS Trading and Marketing Pvt. Ltd. The App provides exclusive deals, discounts, and privileges for customers. By accessing or using the App, you agree to these Terms and Conditions.

2. Eligibility

  • You must be at least 18 years of age to use this App.
  • The App is intended for individual users only.

3. User Accounts
To create an account, you must provide your name, email, contact number, and location.

  • If you do not purchase a plan within 30 days of signing up, your account will be terminated 
  • If you do not renew your subscription in the time of renewal, your account will be suspended automatically without prior notice.
  • Users are responsible for maintaining the confidentiality of their account information and ensuring it is accurate and up-to-date.

4. Subscription Plans

  • Basic Plan: Grants access to basic offers only.
  • Premium Plan: Grants access to both basic and premium offers.
  • Pricing: Subscription pricing may vary depending on the service provider.

5. Use of the App Users must comply with all applicable laws and avoid any misuse of offers.
If any fraudulent activity is detected, users will be notified via email, and the account will be terminated.

6. Offers and Discounts

  • Offers and discounts are displayed within the App and are provided by registered merchants.
  • Merchants may apply their own terms and conditions to their offers, which may vary by offer / region.
  • The number of times an offer can be used depends on the merchant's terms and conditions.

7. Payments

  • Payments for purchasing plan / subscription are processed through payment gateways we registered.
  • Customers have maximum of 30 days after signup to complete the payment.
  • In the case of a failed transaction, users will be informed via email. If the issue is not resolved within 30 days, the account will be terminated.

8. Dispute and Resolution
You have 30 days to dispute any charge or payment processed by Sways Trading and Marketing Pvt. Ltd. If you believe a charge is incorrect or have questions about a payment, please contact our customer support team. We will promptly investigate the issue and work with you to resolve the matter.

9. User Responsibilities
Users are responsible for ensuring that the information they provide (e.g., contact details, email) is accurate and up-to-date.
Any changes to these Terms and Conditions will be notify within the App.

10. Indemnification
You agree to indemnify, defend, and hold harmless Sways Trading and Marketing Pvt. Ltd. and its affiliates from any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative), and expenses brought by a third party against Sways Trading and Marketing Pvt. Ltd. arising from or related to: (i) your use of the App, (ii) any breach or violation of these Terms and Conditions by you, or (iii) any actions or omissions on your part. The provisions of this section shall remain in effect even after the termination of these Terms and Conditions.11. Limitation of Liability
Sways Trading and Marketing Pvt. Ltd. shall not be liable for any non-performance or delay in performance of its obligations under these Terms and Conditions caused by any reason, whether within or outside of its control. This includes, but is not limited to, events such as natural disasters, technical issues, legal regulations, or any other unforeseen circumstances.

12. Termination of Account

  • If users do not renew their subscription or fail to purchase a plan within 30 days of signup, their account may be suspended or terminated.
  • In the event of fraudulent activity or other violations, users will be notified via email before account termination.
  • Users have the right to delete their own accounts at any time.
  • Upon termination of the customer account for any reason, User ‘s details and other data will be deleted. SWAYS TRADING AND MARKETING PVT LTD is not responsible for the loss of any User Content.

13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of India. Any legal disputes will be subject to the jurisdiction of the courts in India.

14. Changes to the Terms and Conditions
Sways Trading and Marketing Pvt. Ltd. reserves the right to modify or update these Terms and Conditions occasionally to reflect changes in business or legal requirements. Any significant changes will be communicated to users via the App. Continued use of the App following changes signifies acceptance of the updated Terms.

15. Term and Termination of the Services.
Term of Services: The initial term of the Services purchased by you will be for the time period set forth in the registration form presented to you when you order the Services (the "Initial Term"). Unless you cancel prior to the end of the Initial Term or as otherwise stated in a notice sent to you at least thirty (30) days prior to the expiration of your then-current term, the Services will automatically renew for successive periods of equal length as the Initial Term (each a "Renewal Period"). You acknowledge, agree, and authorize us to automatically bill the applicable fee and unless you terminate or cancel the Services prior to such charge as provided in this section. The "Term" of this Agreement shall include the Initial Term and all Renewal Periods, if any.

Termination Procedure: You may terminate or cancel the Services you purchased at any time during the Term givenby notice by Email or phone or chat . The cancellation request is subject to verification of ownership of the account, as determined in SWAYS TRADING AND MARKETING PVT LTD sole discretion. In the event of such cancellation, you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation subject to the terms of the thirty (30) day money-back guarantee if applicable. After the account is cancelled, all User Content will be permanently removed from the server. Please make a backup of all User Content before you contact SWAYS TRADING AND MARKETING PVT LTD to cancel your account.

Disabling automatic renewal option: You may disable the automatic renewal option for your membership via the Account Renewal section in your dashboard. Please make a backup of all User Content before you disable renewal.

Termination by SWAYS TRADING AND MARKETING PVT LTD: SWAYS TRADING AND MARKETING PVT LTD may terminate your access to the Services, in whole or in part, including deletion or confiscation of all files, content, without notice in the event that: (i) you fail to pay any fees due hereunder to SWAYS TRADING AND MARKETING PVT LTD; (ii) you violate the terms and conditions of this Agreement; (iii) your conduct may harm to us or others, cause SWAYS TRADING AND MARKETING PVT LTD or others to incur liability, or disrupt SWAYS TRADING AND MARKETING PVT LTD business operations (iv) you are abusive toward SWAYS TRADING AND MARKETING PVT LTD staff in any manner; or (v) for any other lawful reason, including to comply with applicable law, or as otherwise specified in this Agreement. In such event, SWAYS TRADING AND MARKETING PVT LTD will not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such termination.

Modification of Services: SWAYS TRADING AND MARKETING PVT LTDreserves the right to modify, change, or discontinue any aspect of the Services in ddata at any time.

16. Limitation of Liability
Sways Trading and Marketing Pvt. Ltd. shall not be liable for any non-performance or delay in performance caused by reasons outside of its control. This includes events such as natural disasters, technical failures, or other unforeseen circumstances.
